1) Who we are & how to contact us
Genesis Sports Management, LLC ("Genesis," "we," "our," "us") is a Alabama limited liability company headquartered at 1234 Victory Way, Austin, TX 78701, USA.
We send important notices via your account inbox, email, push notifications, or postal mail (collectively, "Notice").
2) Scope of this policy
This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use the Platform, and describes choices and rights you may have under U.S. law.
This Policy works together with our Terms of Use, Acceptable Use Policy, and other posted policies. If any term here conflicts with a product-specific notice we present to you, that product-specific notice controls for that product or feature.
3) The information we collect
A. Information you provide
Account & profile data: name, display handle, email, password, date of birth, school/affiliation, sport, jersey number, biography, profile media.
Identity & age verification: government-issued ID, selfies/short videos for liveness checks; if you are under 18, we may also request parent/guardian identification and consent documentation.
Financial & payout data (Creators): bank or e-wallet details (or an adult custodian's, if the Creator is a minor), tax information (e.g., W-9) for reporting obligations.
Compliance contacts (e.g., school or conference compliance officers) to verify Student-Athlete status or NIL requirements where appropriate.
Service providers that help us with identity verification, analytics, security, support, and content moderation.
4) How we use information
We use your information to:
Provide and improve the Platform, including account creation, content hosting, livestreams, and messaging.
Process payments and payouts, apply platform fees, and satisfy tax/receipt obligations.
Verify identity/age and protect competitive integrity (e.g., detect cheating, fraud, scraping, and abuse).
Moderate content using a combination of automated tools and trained humans, and enforce our policies.
Communicate with you about subscriptions, changes to services, and required notices.
Ensure NIL and league-rule compliance, including optional outreach to school compliance offices if you authorize it.
Research and analytics: create aggregated and/or de-identified metrics to improve safety, performance, and feature quality.
Legal reasons: comply with law, respond to lawful requests, and enforce our terms.
We may anonymize or aggregate data so it can no longer identify you; we may use and share such data for legitimate business purposes.
5) Our stance on advertising & "sale/share" of data
We do not sell personal information.
We do not engage in cross-context behavioral advertising targeted to minors.
Limited analytics and essential service cookies may run to secure and operate the Platform and to understand product performance.
Where state laws define "share" broadly (e.g., for targeted advertising), we provide a "Do Not Sell or Share My Personal Information" link for applicable residents.
6) Children & minors
Genesis is built for sports communities and safeguarding minors is a priority:
No accounts for children under 13.
Ages 13–17: registration requires verifiable parent/guardian consent. Such accounts are labeled and subject to additional protections, which may include supervised messaging, live-stream delays, and stricter content filters.
Purchases & monetization: you must be 18+ (or the age of majority in your state) to enter paid transactions. Minor Athlete Creators who monetize must provide guardian consent and designate an adult custodian for payouts until majority.
Parents/guardians of a minor user may review, manage, or delete the minor's personal information by contacting privacy@genesis-sports.com from the email associated with the account and completing verification.
We prohibit sexualized content involving minors, private adult-minor chats, and other unsafe conduct; violations may be reported to authorities.
7) When we disclose information
We disclose personal information to:
Service providers/contractors that process data under binding agreements (hosting, payments, identity verification, analytics, security, support, communications).
Other users when you post content publicly or engage in interactions (e.g., your handle, profile, and posted Content are visible to Fans based on your settings).
School or league compliance contacts, but only with your authorization or where required by law or policy.
Successors/affiliates in connection with corporate transactions (merger, acquisition, financing, or asset transfer) subject to this Policy's protections.
Law enforcement, regulators, or courts when we believe disclosure is required by law or necessary to protect users, the Platform, or others; to detect/prevent fraud, cheating, or abuse; or to enforce our terms.
We do not grant third parties ownership of your original Content; Athlete Creators retain IP rights, subject to platform licenses necessary to operate the service.
8) Retention
We retain personal information only as long as necessary for the purposes described here, including to provide the service, comply with legal obligations (e.g., tax and records laws), resolve disputes, and enforce agreements.
Examples (subject to change based on legal needs):
Account data: retained while the account is active; certain records may persist for a reasonable period after closure for fraud prevention, chargeback processing, and legal compliance.
Content & logs: retained for operational continuity, safety investigations, and legal requirements, then deleted or de-identified.
Minor accounts: we strive for shorter default retention after verified deletion requests by a parent/guardian, except where law requires preservation.
9) Your choices & rights
Access/Export: download your data (e.g., earnings, analytics, personal info) from Dashboard → Settings → Data Export.
Correction & deletion: request updates or deletion of inaccurate data (subject to legal/operational limits).
Marketing preferences: opt out of non-essential emails in your account settings or via the email footer link.
State privacy rights (e.g., CA, CO, CT, UT, VA): you may have rights to know/access, correct, delete, opt-out of sale/share, and limit use of sensitive personal info. Use in-app controls or contact privacy@genesis-sports.com.
Appeals: if we deny a privacy request, you may appeal via appeals@genesis-sports.com; if unresolved, you may contact your state AG or applicable regulator.
10) Security
We implement technical and organizational measures to protect personal information (access controls, encryption in transit, monitoring, and abuse detection). No system is perfectly secure; you are responsible for maintaining the confidentiality of your login credentials and promptly notifying us of any suspected compromise.
11) Payments & tax
Payments are processed by third-party processors; Genesis does not store full payment card numbers. Where required, we issue informational tax forms (e.g., Form 1099-K in the U.S.) and may collect additional tax data to meet compliance obligations.
12) International users
Our services and servers are primarily located in the United States. If you access the Platform from outside the U.S., you understand that your information may be transferred to, stored, and processed in the U.S. (and other locations of our service providers), where privacy laws may differ.
13) Changes to this Privacy Policy
We may update this Policy to reflect legal, technical, or business changes. When required, we will provide advance Notice (e.g., 14 days) before changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Policy.
14) How to make a complaint
If you believe we've mishandled your data, contact complaints@genesis-sports.com. We'll acknowledge within 48 hours and aim to provide a written outcome within 14 calendar days. If you're unsatisfied, you can use our Appeals Policy or pursue remedies available under applicable U.S. law.
